What the panel ordered
applicant’s Petition for Reconsideration of the December 17, 2020 Findings and Order is DISMISSEDp. 2
We previously granted reconsideration in order to allow us time to further study the factual and legal issues in this case. We now issue our Opinion and Decision After Reconsideration. We have considered the allegations of the Petition for Reconsideration and the contents of the report of the workers’ compensation administrative law judge (WCJ) with respect thereto. The WCJ recommends we deny reconsideration because the issues raised on reconsideration were not raised at trial. We have also received correspondence from defendant dated March 29, 2021 which represents that defendant has made the adjustments that applicant requested in his petition. Based on the representations made by defendant in its March 29, 2021 correspondence, we will vacate our grant of reconsideration and dismiss applicant’s petition as moot.

About this page
- A published decision of the California Workers' Compensation Appeals Board, taken apart by what it turned on. The Board publishes the decision itself; this page adds the extraction and quotes the passage behind every claim.
- The injured worker is not named here, and the case caption is not printed. Physicians appear as the decision names them, because a medical opinion is an act in a public proceeding.
