What the panel ordered
The Petition for Removal is denied.
Defendant filed a Petition for Removal of the WCJ's Minute Order issued on July 27, 2021.
What was disputed, and how it came out
Each issue the panel decided, with the reasoning it gave. An outcome is what this panel did on this record — not a rule, and not a prediction.
The Appeals Board denied the Petition for Removal because the defendant did not show substantial prejudice or irreparable harm if removal was denied, nor that reconsideration would be inadequate if a final adverse decision was issued.
From the decision · page 1We have considered the allegations of defendant's Petition for Removal and the contents of the report of the workers' compensation administrative law judge (WCJ) with respect thereto. Based on our review of the record and for the reasons discussed below, we will deny removal.
