What was disputed, and how it came out
Each issue the panel decided, with the reasoning it gave. An outcome is what this panel did on this record — not a rule, and not a prediction.
Defendant's petition primarily attempts to relitigate the issue of permanent total disability which was finally decided and not appealed; defendant failed to pay undisputed portions of the award, constituting bad faith conduct; petition is denied.
From the decision · page 3IT APPEARING THAT on September 16, 2021, defendant filed a timely and verified Petition for Reconsideration from the Findings, Award, and Order issued on August 25, 2021, which determined applicant's wage rate and awarded the amount of total disability benefits due pursuant to that wage rate, and further found that defendant improperly delayed payment of permanent total disability benefits and awarded penalties and interest accordingly. Lastly, I ordered defendant to pay any undisputed portion of applicant's permanent total disability award immediately, regardless of whether defendant sought reconsideration on the issues of applicant's wage rate, penalties, and interest.
